CHILD PROTECTION AND CHILD LABOUR POLICY

Students Wellbeing Foundation of India (SWFOI)

 

1. Policy Statement

Students Wellbeing Foundation of India (SWFOI) is committed to protecting children and young persons from abuse exploitation neglect and harmful practices including child labour.

The safety dignity and wellbeing of every child is a priority for SWFOI.

2. Scope of This Policy

This policy applies to

• Children and young persons engaging with SWFOI programs
• Students below eighteen years of age
• Members volunteers and leaders interacting with minors
• All SWFOI activities platforms and communications

This policy applies within India only.

3. Definition of a Child

For the purpose of this policy a child is any individual below the age of eighteen years as per Indian law.

4. Understanding Child Protection

Child protection includes preventing and responding to

• Physical abuse
• Emotional or psychological harm
• Sexual abuse or exploitation
• Neglect or abandonment
• Forced labour or economic exploitation
• Unsafe environments or activities

SWFOI aims to create safe respectful and supportive spaces for children and young students.

5. Child Labour Position

SWFOI strictly opposes all forms of child labour.

SWFOI does not
• Employ children
• Promote child labour
• Support activities involving illegal employment of minors

Where child labour concerns are identified SWFOI may provide guidance awareness and coordination support with appropriate authorities or organisations.

6. SWFOI Role and Limitations

SWFOI provides

• Awareness and education
• Guidance and coordination support
• Direction towards appropriate authorities or support systems

SWFOI does not act as
• A law enforcement agency
• A rescue authority
• A legal or judicial body

In cases of immediate danger or illegal activity individuals are advised to contact local authorities directly.

7. Responsibilities

Organisational Responsibility

SWFOI shall
• Promote child safe practices
• Take reasonable steps to prevent harm
• Act responsibly on reported concerns
• Maintain confidentiality within legal limits

Individual Responsibility

Members volunteers and leaders must
• Act responsibly around children
• Follow safeguarding guidelines
• Report any suspected abuse or exploitation
• Avoid any behaviour that could place a child at risk

8. Reporting Child Protection Concerns

Concerns may include

• Abuse or neglect
• Exploitation or forced labour
• Unsafe living or working conditions
• Behaviour causing harm to a child

Concerns should be reported through SWFOI communication channels.

SWFOI will assess information and decide appropriate guidance or escalation.

9. Confidentiality

All child protection concerns are handled sensitively.

However confidentiality cannot be guaranteed where
• A child is at risk
• Disclosure is required by law
• Authorities must be informed

10. Action and Response

Upon receiving a concern SWFOI may

• Provide guidance and emotional support
• Share information on child protection mechanisms
• Coordinate with relevant authorities or organisations
• Restrict or terminate association of individuals involved

All actions are taken at SWFOI discretion.

11. No Guarantee of Outcome

While SWFOI aims to support child protection efforts

• Outcomes depend on external authorities
• Resolution timelines may vary
• Specific results cannot be guaranteed

12. Misuse of Policy

False malicious or misleading complaints are taken seriously.

SWFOI reserves the right to take appropriate action against misuse.

13. Limitation of Liability

SWFOI shall not be held liable for

• Actions taken by authorities or third parties
• Outcomes of external interventions
• Consequences arising from reliance on guidance provided

Engagement with SWFOI is voluntary and at individual discretion.

14. Policy Review

SWFOI may revise this policy at any time without prior notice.
The latest version published on the website shall be final and binding.
